Lahore: Bail plea of rape accused referred to another court
LAHORE: Additional District and Sessions Judge Mian Khalil Naz has referred the bail application of accused Zubair, involved in the rape of seven-years-old Tayyeba, to the district and sessions judge to fix it before the judge who was already proceeding with the trial of the accused.
The judge passed this order on Monday after knowing that the record of Zubair’s case could not be presented to him.
On March 11, Zubair, Talha, Muzamil and Muzaffar allegedly raped Tayyeba in Sidhanwali village in Ferozewala, when she was returning home from school.
Former inspector general (IG) of police Azhar Hasan Nadeem had suspended deputy superintendent of police (DSP) and station house officer (SHO) of Narang Mandi police station for defending Zubair and for not nominating him in the first information report (FIR). However, after the action against the DSP and SHO, the police arrested Zubair, but declared the others innocent and released them.
On Monday, five lawyers voluntarily appeared before the court for Tayyeba and opposed the bail application of the accused. The lawyers were Aneer AA Sadi, Muhammad Razaq Ibrahim, Muhammad Irfan, Mian Saif Bashir and Muhammad Jahangir.
The counsel for the accused submitted that Zubair was innocent and that no rape had taken place at all. On this, the counsel for Tayyeba, producing medical and chemical reports, submitted that rape was proven through the reports and that police had declared Zubair an accused in the investigations.
