Man files habeas corpus petition against APA Landikotal
PESHAWAR: Sawab Sher, a resident of Mathra village Peshawar has filed a habeas corpus petition at the Peshawar High Court (PHC) against the alleged illegal detention of his mentally ill brother by the assistant political agent (APA) of Landikotal, Khyber Agency.
The petitioner said that his brother, Mohtaram Sher, 22, who suffered from severe Schizophrenia, was under treatment at the NWFP Mental Hospital when he went missing from his home in March 2006.
Mathra Police SHO disclosed one-and-a-half-years later that Mohtram had been in the custody of NATO forces in Afghanistan on multiple charges.
NATO authorities released Mohtram in January 2008 after Dr Mohammad Tariq of the NWFP Mental Hospital provided it with documents certifying Mohtram’s mental condition.
NATO officials handed over Mohtram to APA Landikotal, who has kept him in illegal detention ever since, the petitioner alleged in the writ. The petitioner said that the APA arrested Mohtram without any warrant, adding that he had no jurisdiction over a citizen from the settled areas of the country. Mohtram was innocent of all charges against him and suffered from serious mental disease, said the petition, adding that it was essential to provide urgent treatment to the patient. It also said that neither Mohtram nor any member of his family belonged to any banned religious outfit.
