KARACHI: Hanif Merchant, one of the partners in Tessori Limited, filed on Wednesday a reference before the Supreme Judicial Council (SJC), asking it to remove Sindh High Court (SHC) Chief Justice Muhammad Afzal Soomro on charges of alleged misuse of powers.
Anwar Mansoor Khan, the counsel for complainant Hanif Merchant, said that he had sent the reference to the SJC along with the necessary annexure that contained proof of how a case fixed before the company judge (a judge of the SHC adjudicating limited company matters) was heard and decided by the chief justice.
According to the counsel, the case — a judicial miscellaneous application — was pending before the company judge (Justice Khalid Ali Z Kazi at the time) and was fixed for hearing on April 29. He alleged that the CJ had summoned the case file to his chambers, following which he summarily disposed of the case without hearing the appellant.
