Lahore: Pre-arrest bail of murder accused confirmed
LAHORE: Justice Khurshid Anwar Bhinder of the Lahore High Court has confirmed ad-interim pre–arrest bail of a murder accused while observing that the case requires further inquiry. It was alleged that petitioner Muhammad Gulzar along with his son had tried to demolish the gate of the house of the complainant whereupon the complainant along with his other family members had an altercation with the petitioner. Resultantly, the deceased was murdered by the petitioner and his son.
The petitionerís counsel argued that only Japha (hug) was attributed to the petitioner and he being an old man of 65 was not strong enough to hold the deceased. The counsel said the petitioner was not present at the time of occurrence; rather he was present at his native city Jhelum.
The counsel also referred to the medical report as well as post mortem report which revealed the fact that there were simple bruises on the body of the deceased and the real cause of death was cardiac arrest and not because of those injuries.
Meanwhile, the complainant counsel opposed the bail application pleading that petitioner was nominated in the FIR with specific role. He said the deceased died due to the injuries caused by the petitioner and his son and the petitioner actively participated in the occurrence.
Deputy Prosecutor General also opposed the bail application of the petitioner, however, the judge observed that the evidences and circumstances proved malfide intention on the part of complainant.
Hence the judge confirmed ad-interim pre–arrest bail already granted to the petitioner subject to furnishing fresh bail bonds of Rs. 50,000 with two sureties bonds.
