Karachi: 2 acquitted of kidnapping charges
KARACHI: Two men have been acquitted of charges of kidnapping their daughters and granddaughters by the Anti–Terrorism Courts (ATC). Nisar Ali and his father Adam Khan were tried by the ATC for kidnapping the former’s daughters, six–year–old Muskan and five–year–old Naina, in July 2007. According to the prosecution, Ms. Samina, ex-wife of Nisar, lodged a First Information Report (FIR) at Bhittai Nagar police station, Hyderabad, alleging that Nisar, his father Lal Bux and two others came to her house, and put some intoxicants in milk. After drinking the milk, Samina, her sister Taslima, her father Mohammad Ayub and mother Manzoora fell unconscious. When they regained consciousness, her daughters were not in the house, while cash and valuables were also missing. The prosecution alleged that the accused took the girls to Larkana and demanded Rs500,000 in ransom for their release. The abductees were recovered from Larkana and the defendants were put on trial.
Special Public Prosecutor Mohammad Taseer Khan, after reading out the evidence of the prosecution witnesses, prayed to the court that the accused may be convicted so that society could be cleansed of such offences.
Defence counsel Shoaib Mohammad Ashraf contended that the defendants were implicated in a false case to obtain custody of the minors. He submitted that from the facts and circumstances, it seemed as if the defendants left the house and came back again to abduct the girls. Ashraf argued that a major question was left unanswered regarding why the girls were not abducted when the men came to house the first time around. Further, it did not transpire, either from the FIR or in the evidence of prosecution witnesses, that the defendants had left and come back again.
The ATC headed by Judge Abdul Ghafoor Memon observed that there exist material contradictions in evidence provided by the prosecution, while the recovery of the abductees was also doubtful.
The court observed that the prosecution failed to prove its case with regard to the abduction for ransom and robbery against the defendants. Acquitting both the defendants of abduction for ransom charges, the court ordered to release them if not required in other cases.
