Lahore: LHC orders registration of case against cops
LAHORE: Justice M A Zafar of the Lahore High Court ordered registration of a case against DSP Ferozewala Sahibzada Tariq, Inspector Shafqat and ASI Mohammad Akbar for detaining an innocent citizen. The judge directed the SHO Ferozewala to register the case on written complaint of detainee Babar. The judge directed to send the copy of this order to the district police officer, Sheikhupura, who shall ensure the compliance of this order and should submit compliance report to deputy registrar (judicial) of the High Court.
For release of Babar, his mother Ashkara Begum moved a habeas corpus petition alleging that Tariq, Shafqat and Akbar along with three constables in private uniform raided her house on December 20, 2008.
She alleged that the police officials forced her to vacate the house failing which they would not spare her and other family members.
\She further alleged that on her refusal the police officials took Babar with them and detained him in police station. She alleged that due to the influence of the Qabza Group (land mafia) who wanted to grab her house, the police had detained her son.
Justice Zafar had deputed a bailiff who raided the police station and recovered Babar who was tied with a rope. ASI Akbar informed the bailiff that Babar and other family members were accused in a fraud case. ASI also said that Babar was granted interim bail and was summoned in the police station for investigation of the case and was not detained and the complainant of the case was also present there.
Judge, while ordering for registration of case against police officials, observed that the facts and circumstances of the case clearly showed that detainee was kept in illegal detention by the police in order to pressurize him and his other family members to vacate the house. The SHO, being overall incharge of the police station, was equally responsible for the offence.
