Karachi: 7 men assoiled in arson attack case
KARACHI: As reported by the Dawn News on Friday. a sessions court on Thursday acquitted seven men in a case pertaining to an arson attack on a restaurant, in which six persons were burnt to death, for lack of evidence. Iftikhar Hussain, Wajid Hussain, Muhammad Nafees, Syed Iftikhar Hussain, Zahir Hussain, Shabbir Hussain and Ali Haider were charged with setting a fast-food restaurant on fire within the remit of the Gulshan-i-Iqbal police station in May 2005. Additional District and Sessions Judge (east) Sanaullah Khan Ghory pronounced his verdict after recording testimonies of witnesses and final arguments from both sides. The court in its judgment said that after the appraisal of the whole evidence brought up on record, the prosecution had examined four witnesses who claimed to be present at the crime-scene when the incident took place, but during their statements before the trial court they simply stated that a mob was protesting against the bomb blast at a nearby Imambargah. They also failed to assign any specific role to the present accused. As for the identification parade of the accused, in which two eyewitnesses rightly picked up all accused except Ali Haider, the court ruled that during their statements before court the witnesses had not stated specifically that which accused pelted stones causing damages and setting the restaurant alight. Besides, both witnesses during the cross-examination admitted that investigation officer sub-inspector Tariq Ali had exposed the faces of the accused to them before the parade, thus the identification parade had lost the credibility and this sole aspect of the case was enough to destroy the veracity of the prosecution case, the judgment added. According to the prosecution, following a bomb blast at the Imambargah in Gulshan-i-Iqbal on May 30, 2005, enraged people took to the streets, damaged vehicles and set a fast-food outlet on fire in which six persons were burnt alive. The case (FIR 288/2005) was registered under Sections 147, 148, 319, 427, 435 of the Pakistan Penal Code on the compliant of the restaurant’s manager and the police arrested six suspects. Later, they were released on bail.
