Karachi: Man recovered from ‘illegal’ police custody
KARACHI: The Dawn News reported on Thursday, a judicial magistrate on Wednesday raided the Saeedabad police station and recovered a man detained in the lock-up after police failed to produce any evidence justifying his detention.
The judicial magistrate, Rasool Bukhsh Mirjut, got Mohammad Pervez released on a personal bond of Rs5,000 and directed the station house officer and senior investigation officer of the Saeedabad police station to appear before a district and sessions court (west) on Thursday.
According to a court official, the detainee was found in the police lockup during the raid and the police officials told the magistrate that they had arrested the man in a murder case.
However, he was neither nominated in the FIR nor any other evidence was produced against him in order to establish his link with the alleged crime.
The victim’s mother had earlier filed a habeas corpus application under Section 491 of the criminal procedure code in court.
In her petition, she said police picked up her son six days back and unlawfully detained him at the Saeedabad police station. She prayed to the court for the recovery of her son.
After a preliminary hearing, district and sessions judge (west) Dr Qamaruddin Bohra directed the magistrate to conduct a raid on the information provided by the applicant and recover the victim if found in wrongful confinement.
