Islamabad: Adiyala jail chief, deputy apprehended over kidnapping of 11 persons
ISLAMABAD: According to the Dawn News on Wednesday, the superintendent and the deputy superintendent of Adiyala jail were arrested on Tuesday from the Supreme Court after they appeared in a case about alleged abduction of 11 men from the prison following acquittal in four terror cases.
Police arrested Saeedullah Gondal and his deputy, Khalid Bashir, after a three-judge bench comprising Chief Justice Iftikhar Mohammad Chaudhry, Justice Ghulam Rabbani and Justice Khalilur Rehman Ramday asked the Rawalpindi police chief to explain about the progress police had made in the case registered on the orders of the Lahore High Court in June.
The bench had taken up a petition filed by Attiqur Rehman and others against the alleged abduction from Adiyala jail of Dr Niaz Ahmed, Mazharul Haq, Shafiqur Rehman, Mohammad Aamir, Abdul Majid, Abdul Basit, Abdul Saboor, Shafique Ahmed, Said Arab, Gul Roze and Tehseenullah. They had been acquitted by trial courts in four terrorism cases.
When the bench asked the Rawalpindi CPO about the legal position of police investigations into the case against jail officials, he said the investigators had not cleared Saeedullah Gondal and Khalid Bashir.
He said that a joint team headed by him was investigating the case.
Advocate Mohammad Ilyas Siddiqi, the counsel for the petitioners, told Dawn that the Supreme Court had directed the Punjab IG (prisons) to appear before it on Nov 1 and explain the conduct of the Adiyala jail chief. The court also summoned the Punjab home secretary.
The petitioners have challenged a decision of the Rawalpindi bench of LHC that they should approach a judicial commission set up by the Supreme Court for the cause of missing persons. They said that their relatives had been abducted from the Adiyala jail and they did not go missing.
The petitioners said the 11 men had been acquitted in April of all charges in cases related to rockets attack on the Pakistan Aeronautical Complex in Kamra, anti-aircraft shots fired at a plane carrying former president Pervez Musharraf and suicide attacks on the bus of an intelligence agency in Rawalpindi and at the main entrance of the GHQ.
They said the Punjab home department had issued detention orders for the men after their acquittal. However, the LHC later set aside the orders and directed the jail authorities to release them in May, but instead of setting them free, the jail management allegedly handed them over to intelligence agencies.
The petitioners said they had filed a contempt of court plea in the LHC, which ordered the registration of an abduction case against the Adiyala jail chief. But he did not obtain bail after his appeal against FIR was not entertained by the LHC.
Saeedullah Gondal and Khalid Bashir have been shifted to a police checkpoint in the premises of Adiyala jail for further investigation.
