Karachi: Registration of case against doctor ordered
KARACHI: As reported by The News on Saturday, Additional District and Session Judge, Central, Mohammed Azeem, has ordered the Station House Officer (SHO), Gulberg, to register an FIR against Doctor Tariq Mehmood of a local hospital against the criminal negligence of the doctor.
The order announced on Friday that if cognizable offence has been committed by the doctor a case would be registered against the doctor under Section 154 of the Criminal Procedure Code and if the report of the applicant was found to be false, then action according to law be taken against him.
According to details, a resident of Ghotki, Krishan Rathore, filed an application under Section 22-A of CrPC through his counsel Nasir Ahmed in the court stating that on August 7, 2010, he contacted Sambroze hospital as his wife Shrimati Bhagwami was having some problem.
The doctor on duty Tariq Mehmood examined her and said that her gall bladder was not functioning normally and would have to be removed to save her life.
The same day she was operated upon and the gallbladder was sent to the histopathology section. He also charged Rs 55,000 for the operation. Despite the operation, his wife’s condition continuously deteriorated following which he contacted the doctor who put him at ease by saying that recovery in this case needed some time and as such, there was nothing to worry.
Despite continuous complaint of pain doctors used to say that it will take time. Failing to get any positive response, Krishan approached another hospital in Sukkur where he was informed through ultra–sound that gall bladder of his wife was not removed.
In his application he stated that he contacted SHO Gulberg for registration of an FIR, The duty officer Hanif Raja received the application on October 28 but did not register case against the doctor.
He prayed to the court to order registration of an FIR against the doctor. The SHO, Gulberg, submitted in the court that allegations were false and baseless, that applicant had given complaint to the PS but he did not come at the PS to get the action initiated. He prayed to the court that applicant be directed to approach SHO for legal help.
After hearing from both sides, the judge directed the SHO to lodge an FIR after complete inquiry and if offence is committed action be taken against the doctor.
