Illegal gateway exchange; Non-bailable arrest warrants issued for Chinese, Pakistani
ISLAMABAD: Federal Investigation Agency (FIA) on Friday obtained from the district court non-bailable arrest warrants for a Chinese and a Pakistani. The court ordered FIA to arrest the alleged persons as soon as possible and produce them in the court.
The case is in the court of Senior Civil Judge Mehmood Haroon. According to FIA officials, the alleged persons were involved in illegal terminating international traffic using unauthorized Voice over Internet Protocols (VoIP) and giving loss of millions rupees to national exchequer.
The court also ordered FIA to arrest the alleged persons and produce before court as soon as possible. A first information report (FIR) was registered dated on October 27, 2009 against Jonathan Huang (Chinese national) and Akhtar Hussain under sections 31 of PTA 1996, and 6, 7, 8, 9, 19, 20 of Pakistan Electronic Crimes Ordinance (PECO) 2009, r/w 420 PPC with FIA Cyber Crime Circle Rawalpindi. The complainant into the case was Zonal Director Rawalpindi Pakistan Telecommunication Authority (PTA).
According to FIA, PTA, through systems, deployed for monitoring and reconciliation of International Telephony Traffic (ITT), has reason to believe that Huang along with others without obtaining any license was involved in illegal termination of International Voice Traffic using unauthorized VOIP gateway installed at Gulrez Housing Scheme II Rawalpindi. The FIA stated that it was an offence Under Section 31 of Pakistan telecommunication (Re-Organization) Act, 1996.
According to law, PTA is empowered to regulate telecommunication services and system in Pakistan. Section 20 of the Act provides that no person can provide telecommunication services or establishes telecommunication system without obtaining a license.
The complainant submitted relevant record of all the calls terminated through this system. FIA accordingly initiated legal action by registering a case against the offense and obtained search warrant from the court of Judicial Magistrate. The FIA team raided the place where the accused persons were found running an illegal gateway Exchange. Gateway server filled with 4Xvoice Cards, Main Server, CPU 4.PABX (Exchange Filled with voice cards2+4), Modem (Us Robotics 56 K) 7.D Link switch, bay lane unit 9.1inksys switches 10.2 x pads and other relevant record was confiscated during the raid. Meanwhile the accused persons could not be arrested on the spot.
According to FIA, the Huang is a legal Chinese immigrant and residing in Pakistan since 2006. During preliminary investigation it was found that the Chinese immigrant running a business of import computer parts and computer network accessories from China and Singapore. The accused Hussain is a fast friend of Huang and Chinese immigrant delivered the computer and network accessories by the orders of clients.
On Friday FIA official filed a request for issuance of non-bailable arrest warrant of accused persons through application and informed the court that during investigation all efforts were made to arrest both the accused but they were deliberately deflecting their arrest.
