Islamabad: Man maligning Zardari on Internet declared absconder
ISLAMABAD: Additional Sessions Judge Yaar Muhammad Gondal on Thursday declared a man absconder for not appearing before court after getting bail in a case for uploading malicious material against President Asif Ali Zardari and hacked a local website.
Meanwhile, the court ordered Federal Investigation Agency (FIA) to arrest the accused at the earliest and produce before court for further proceeding regarding the case.
A First Information Report (FIR) was lodged against the accused under section 36, 37 ETO 2002. According to FIA, enquiry initiated on the report of Muhammad Naseem, Principle Investigator IPs 184.108.40.206 and 220.127.116.11 were being used to deface the website (www.president-of-pakistan.com) and uploaded material defaming the President and the country.
The subscriber for the aforementioned IPs was Shahbaz Khan, a resident of Pindi Ghep. A case was registered on prima facie evidence under sections 36 and 37 of ETO against the username” ADiL/Th3-penetrator” and aforesaid IPs with the permission of the competent authority.
The FIA on December 5, 2010 constituted a raiding team consisting of Senior Investigator (Technical) Fakharuslam, Sub Inspector Fazal Maabood, and Constable Wasif Waseem Shah. The team raided the Shop no 11, National Market Pindi Gheb and arrested the accused Shahbaz Khan. Khan, during probe, owned up that ADIL/Th3-penetrator was his username and had logged in several times by it. CPU, DSL modem, and other equipment used in the crime were seized. According to FIA investigation, the accused disclosed that (www.president-of-pakistan.com) was hacked by some international hackers and they themselves uploaded obnoxious material and remarks.
Later, the FIA produced the accused with complete chalan and informed the court during interrogation that the accused admitted that ADIL/Th3-penetrator was his username, and he logged in several times by using the same username. At the time CPU (Centeral processing Unit), DSL Modem, and other technical instrument involved in hacking were seized and memo was prepared on the spot. According to FIA Technical Forensic Report, it was found that images/screenshots of defamatory material to the President and the country and thereby the website was blocked by the Internet service provider.
Later on July 1, 2011the accused got bail from Supreme Court (SC) Justice Nasirul Mulk and case again was referred to district court. By the orders of SC former Additional Sessions Judge Tanveer Meer released the accused and directed him to appear before court in every hearing regarding that matter. While the accused did not do so. The said court summon Khan many times after bail but he did not not responded to court, Finally the competent court declared him absconder and adjourned the case till October 27, 2011.
