Lahore: PML-N MPA granted bail in fraud case

LAHORE: The Lahore High Court on Friday granted post-arrest bail to former PML-N MPA from Sargodha Rizwan Gill who was disqualified for holding fake graduation degree and arrested on charges of committing fraud. An election tribunal of the LHC last year had de-seated Gill after the Punjab University had declared his degree bogus.

Gill had assailed that order in the Supreme Court which not only dismissed his appeal but observed that Election Commission of Pakistan should initiate criminal proceedings against such fake degree holders. Eventually, the police lodged an FIR against him with the Civil Lines police station, Sargodha, and arrested the former assembly member and he was languishing in jail for more than two months.

The petitioner moved a bail application in the LHC through his counsel Azma Nazir Tarar who contended that burden of proof should be beyond doubts and election tribunal had conducted only summary trial while disqualifying him.

He argued that Gill had been charged under section 420 of the PPC and section 82 of People’s Representative Act which did not fall under the prohibitory clause of section 497 of CrPC. Justice Kazim Raza Shamsi granted the bail to Gill and observed that the trial against him was still pending and it should be decided on the basis of evidence available with the trial court.

The judge further remarked that the trial court should conduct a free and fair trial without being influenced by the finding made by the LHC and the SC in such cases.
