PESHAWAR: The Peshawar High Court (PHC) on Monday directed the deputy inspector general (DIG) of police, Malakand division and district police officer of Upper Dir to immediately arrest the killers of father and brother of a four-year-old girl after the latter refused to give her as Swara.
A single bench of Chief Justice Dost Muhammad Khan also directed the secretary home, DIG and commissioner, Malakand division and district police officer, Upper Dir to immediately provide protection to the entire family of the girl, Asma, and deploy special security force at her residence.
The bench also directed the capital city police officer to provide a special squad to escort the girl and her younger brother Faizur Rehman from Peshawar up to her home in Upper Dir district.
The bench directed the officials concerned to arrest the killers and produce them handcuffed before the court on December 29 at the next hearing of the case.
Hafizur Rehman of Dhoon Serai village in Kalkot tehsil had stated on oath that his minor sister was likely to be kidnapped by the accused including Izzat Muhammad, Nasrullah, Wazir Muhammad, Naqeeb Ahmed, Wali Muhammad and Sherullah, who were allegedly hurling threats at the entire family despite the fact that they had killed the girl’s father Daud, who was a prayer leader, and his brother Abdul Hameed.
He informed the bench that the accused were threatening to kill the entire family if Asma was not given to them as Swara.
Narrating their ordeal, Hafizur Rehman stated that his younger sister Ruqaya had been married to Subhanullah, son of Rahmanullah and a nephew of the accused, about five years ago.
He said Subhanullah, a disabled person, and his family members severely tortured his sister. He said his sister got ‘khula’ on March 27, 2008 from a family court after they expelled her from the house and gave them life threats.
Hafizur Rehman stated that after the court decree, the accused warned his father to hand over his four-year-old daughter Asma in place of Ruqaya as they did not accept the court verdict.
A year after the court verdict, his sister Ruqaya married another person Shahzad in Rawalpindi but the accused continuing warning them. He said on November 12, 2011 his father and brother went to the Kalkot Police Station to inform the police about the life threats and on return both were gunned down. He said he had charged the accused in the murder case of his father and brother, but they were threatening to eliminate his whole family if his minor sister wasn’t handed over to them.
