Karachi: Action ordered against cop for not complying with court orders
KARACHI: A judicial magistrate has directed the inspector general (IG) Sindh to take disciplinary action against Assistant Sub–Inspector (ASI) Hussain Bux Bhutto of the Clifton police station for refusing to comply with court orders despite being issued repeated notices and summons.
The case, which was in session on Wednesday, began with the defence counsel informing Judicial Magistrate South Hatim Aziz Solangi that ASI Bhutto had failed to submit a challan and that his clients — Mumtaz Ali, Waqas Ali, Mohammad Sajid and Zahid Hussain —had been languishing in jail as the IO had failed to submit a charge sheet against them.
The defence also requested the court to discard the case against them by appealing to section 63 (discharge of apprehended persons) of the Criminal Procedure Code. All four accused have been detained in jail since November last year.
However, Assistant Public Prosecutor Syed Shamim Ahmed contended that since each of the suspects had been nominated in an FIR and were currently under detention for cases of murder and robbery, it was not possible for them to be acquitted without facing trial.
Shamim Ahmed requested the court to issue a letter to IG Sindh for taking disciplinary action against the accused. The court then wrote a letter to the IG Sindh, directing him to depute responsible police officials for investigations and to submit a detailed report within three days.
