Lahore: Bail plea dismissed, ‘rapist’ arrested
LAHORE: The Lahore High Court on Thursday dismissed bail application of a landlord of Pakpatan who had allegedly raped a girl. The ‘rape’ had resulted into the birth of a baby boy. On Thursday, an investigation officer (IO) presented a DNA report before the court which proved the crime of the accused. Police arrested the landlord outside the courtroom.
After going through the report, Justice Manzoor Ahmed Malik told the counsel for the accused to withdraw the bail application. The counsel complied with the order.
According to the FIR registered with the Chak Bedi police station, uncle of the victim (S), Hanif, used to rape her time and again by forcing his entering into her house.
The complainant, Daim Ali, the uncle of the victim, submitted that, on December 21, 2011, he went to the house of her niece and found Rao Hanif raping the victim. He alleged that Hanif pointed a pistol at him and managed to escape the scene.
He quoted the victim saying that Hanif had been raping her for last five months, which had led to her pregnancy. She had not informed anyone, afraid of the consequences of threats Hanif had hurled at her, he quoted his niece having said to him.
Accused Hanif in his petition submitted that the case registered against him was based on absolutely false grounds. Some ulterior motive was involved in the registration of the case, he said, adding that there was an inordinate delay of more than five months in lodging of the FIR.
Lack of satisfactory explanation of the delay in the FIR, clearly showed due deliberation and consultation in registration of the case, he said, denying that any such incident had ever taken place. He said the alleged victim was his wife and had been living with him.
He said he had submitted an application before the district and sessions judge (DS&J), Pakpattan, for DNA test, and the court had accepted the plea for the test.
He said the report of DNA had not been received so far and the police should be ordered not to arrest him until report was received.
