Islamabad: Prayer leader found guilty in Rimsha case
ISLAMABAD: The high-powered investigation team concluded the probe into Rimsha case and found Imam Masjid (prayer leader) of MeraJafar mosque Khalid JadoonChishti guilty and declared Rimsha as innocent on lack of evidence, sources told ‘The News’ on Thursday. Bu District Attorney (DA) raised the objections to the investigation before producing the charge sheet of the case before the court, the sources added. According to the sources, the report was finalised under section 173 CrPC. The sourcessaid that Imam Masjid Khalid Jadoon was charge sheeted under section 295-B and 196 PPC. Section 295-B reads as, “Whoever willfully defiles, damages or desecrates the copy of the Holy Quran or its extract, there from or uses it in any derogatory manner or any unlawful purpose, shall be punishable with the imprisonment of life. While, section 196 PPC (using evidence known to be false), says, “Whoever corruptly uses or attempts to use as true any evidence which he knows to be false or fabricated, shall be punishable in the same manner as if he has given or fabricated the false evidence.”
The police found Imam Masjid guilty of hatching conspiracy against Christian girl Rimsha who was arrested by the Islamabad police on the complaint of the Imam Masjid.
Advocate High Court Rizwan Abbasi when contacted by this scribe for his legal opinion about the objections raised by the District Attorney (DA), said that the DA could highlight procedural defects but could not substitute the findings of the investigation officer (IO). The Public Prosecutor/District Attorney could not ask the IO to declare any person guilty or innocent, Abbasi maintained adding, “This is the sole prerogative of the IO to formulate any opinion in the light of evidence available on record.”
He said that the court might disagree with the findings of the IO but it could not direct IO to change his findings. “Under Article 91 of the Qanoon-e-Shahadat, presumption of truth is attached to the statement recorded under section 164 CrPC,” RizwanAbbasi said.
Earlier, the Rimsha case took a new turn when Moazzan of Jamia Masjid of MeraJafar disclosed while recording his statement before the police that the Imam Masjid added some pages of first Separa of the Holy Quran to execute his plan to expel the Christian community from MeraJafar, police sources said.
Two other persons of the mosque, Hafiz Awais and Khurram Shahzad, confirmed the statement of the Moazzan, police sources maintained.
